The Terms and Conditions of Participation in the “NAMX Hold & Win: Round 1” Promotion

The Organizer of the Promotion is the UAB Clear White Technologies company, incorporated under the laws of the Republic of Lithuania under the number LT-03224, and registered at the office address: J. Basanaviiaus g. 26 Vilnius, Republic of Lithuania.

Promotion period: from 12:00 p.m. (UTC) on the 7th of September 2023 until 12:00 p.m. (UTC) on the 13th of September 2023.

The territory of the Promotion: All countries of the world except Afghanistan, American Samoa, the U.S. Virgin Islands, Guam, Iran, Yemen, Libya, Palestine, Puerto Rico, Somalia, North Korea, the Northern Mariana Islands, the USA, Spain, Canada, Syria, Sudan, South Sudan, Transnistria, the temporarily occupied territories of Georgia, Nagorno-Karabakh, Northern Cyprus, Western Sahara, Amazonia, Kosovo, Republic of Belarus, Russian Federation and the temporarily occupied territories of Ukraine.

Official Terms of the Promotion and details of its implementation:

The Promotion is held to promote WhiteBIT services.

The Promotion is not a game of chance, a lottery, a service in the gambling business, or a contest; these Terms are not a public promise of reward.

Information about the Promotion is provided based on advertising rights.

Participants of the Promotion are adults who are citizens of non-prohibited countries (i.e., other than those mentioned above) or other persons who are residing in such countries and who have fulfilled the following conditions:

• Signed up for WhiteBIT for the first time or are already signed-up users of the exchange and confirmed their identities (KYC);
• During the period of the Promotion, bought, deposited, or already had at least 15 NAMX on the Main or Trading balance on the WhiteBIT exchange and held this amount until the announcement of the Winner (the 19th of September 2023).

During the Promotion period, three times randomly (on a random date and time), the Promotion Organizer will take a snapshot of the Main balances of the Promotion Participants on the WhiteBIT exchange.

For each additional 15 NAMX to the minimum amount of NAMX specified in the Promotion Terms and held on the Participant’s Balance, the Participant’s nickname will be included in the final list of Promotion Participants 1 time more. That is, every additional 15 NAMX on balance, which will be recorded by the Organizer on the snapshots taken, increases the Participant’s chance of winning due to the fact that at the stage of forming the Participant list, the Participant’s nickname may enter the randomizer several times.

Pay attention that the maximum possible amount on the Promotion Participant’s Main Balance is 75 NAMX. This means that the nickname of one Participant can appear in the list of Participants at least 1 but not more than 15 times. This does not exclude that the Participant may hold an amount greater than 75 NAMX in their Main balance, but a maximum of 75 NAMX will be taken into account in this Promotion.

The Conditions of the Promotion must be met within the timeframe of its duration.

Any personal data of Participants in the Promotion is processed to ensure participation in the Promotion, marketing relations, advertising relations, tax relations, and accounting relations.

Employees, representatives, or agents of the Organizer and their relatives (first and second degree of kinship) are not eligible to participate in the Promotion. Suppose at the time of the provision of the Prize it is established that the person participating in the Promotion cannot be a Participant of the Promotion following these Terms. In that case, such a person is not entitled to receive the Prize.

Participants of the Promotion have the opportunity to become Winners and to win the Prize of the first Promotion round — 80 NAMX.

The maximum possible number of Promotion Winners — 1 person.

Based on the results of the Promotion in the period from 09/13/2023 to 09/19/2023, the Organizer will form a list of Participants who meet the Promotion Terms and Conditions.

The Promotion Winner will be determined on the 19th of September, 2023, using the random.org service automatically. The Winner is determined by the ranking (place in the list on the https://www.random.org/ service). The Winner’s nickname will be published on 09/19/2023 in this article on the WhiteBIT company blog (https://blog.whitebit.com), as well as a video with the Winner’s selection will be published on the WhiteBIT YouTube account.

The Organizer credits Prizes to the Winner’s wallets on the Winner’s Main balances on the WhiteBIT crypto exchange within 5 business days from the next business day after the announcement of the Winner on the 19th of September.

If it is impossible to contact the Winner or if the Winner fails to comply with these Terms, such Winner loses the right to Winner status, and such right passes to the next Winner in the list.

The Winner receives a Prize for free. The Prize cannot be replaced. The Promotion Winner has no right to demand any other compensation from the Organizer. The Organizer does not bear any warranty obligations for the Prize received within the framework of this Promotion and under the conditions specified in these Terms.

The Organizer inclusively performs the accrual of Prizes to WhiteBIT accounts of the Winner within 5 business days after the announcement of the Winners. The Winner of the Promotion will be informed about the Prize accrual by a letter to the email address specified during registration on the website https://whitebit.com within 5 business days after their accrual.

One Winner can only win one Prize.

In case of non-receipt of the Prize, if the Winner was eligible for it, or in case of any other difficulties, the Winner must contact online support at https://whitebit.com, by email at support@whitebit.com or by chat later than 10/03/2023 inclusive. If the Winner has not applied by 10/03/2023, particularly regarding the issue of not receiving the Prize, the Winner loses the right to receive it.

The Winner determined by the Promotion results cannot transfer the rights to receive the Prize to third parties.

The Winner of the Promotion has the right to refuse the Prize.

The Organizer does not compensate for the additional expenses of the Winner related to the receipt of the Prize. Taxation of the income of the Winner who received the Prize is carried out in accordance with the current legislation.

By participating in the Promotion, the Participant understands and agrees that any information voluntarily provided by him, including the Participant’s personal data, may be processed by the Organizer or third parties involved by him to conduct the Promotion, perform all necessary actions related to it (in particular, but not exclusively, informing about the results of the Promotion both in advertising and in another way), as well as further possible sending of information to the Participant, in particular, of an advertising nature, about the following events/competitions/promotions/raffle of the Organizer. By accepting the requirements of these Terms, the Participants thus consent to such processing of personal data for use by the Organizer and/or other authorized Organizers and confirm their full understanding and necessary awareness of the purposes of processing the information provided, as well as the privacy policy: https://whitebit.com/privacy-policy.

At the same time, by participating in the Promotion, Participants of the Promotion confirm their consent to using their surnames and first names without financial compensation, as well as their agreement to comply with other Terms of the Promotion. The Winner confirms their agreement to provide advertising interviews about participation in the Promotion in the media, particularly on radio and television, and to be photographed for producing graphic materials without paying them any monetary compensation. All exclusive intellectual property rights to such interviews and photographs will belong to the Organizer.

The Organizer reserves the right to change the terms and conditions of the Promotion. In case of any changes, information about this will be provided on the website WhiteBIT and the Organizer’s social networks.

The Organizer does not enter into disputes that may arise between Participants of the Prize Promotion. In situations that allow ambiguous interpretations of these Terms and/or issues not regulated by these Terms, the Organizer of the Promotion makes the final decision in accordance with the requirements of the current legislation. At the same time, the Organizer’s decision is final and is not subject to appeal.

The Promotion Organizer is not responsible for the work of the services of telecommunications companies, postal communication, including e-mail, for any errors of the employees of any enterprises/institutions/organizations that ensure the exchange of information between the Promotion Participants and the Organizer, or circumstances, as a result of which postal items did not arrive, arrived late, were lost or damaged; or as a result of which the Promotion Participant did not receive the corresponding Prize.
