The Terms and Conditions of Participation in the “NAMX Hold & Win: Round 2” Promotion

The Organizer of the Promotion is the UAB Clear White Technologies company, incorporated under the laws of the Republic of Lithuania under the number LT-03224, and registered at the office address: J. Basanaviiaus g. 26 Vilnius, Republic of Lithuania.

Promotion period: from 12:00 p.m. (UTC) on the 20th of September 2023 until 12:00 p.m. (UTC) on the 26th of September 2023. 

The territory of the Promotion: All countries of the world except Afghanistan, American Samoa, the U.S. Virgin Islands, Guam, Iran, Yemen, Libya, Palestine, Puerto Rico, Somalia, North Korea, the Northern Mariana Islands, the USA, Spain, Canada, Syria, Sudan, South Sudan, Transnistria, the temporarily occupied territories of Georgia, Nagorno-Karabakh, Northern Cyprus, Western Sahara, Amazonia, Kosovo, Republic of Belarus, Russian Federation and the temporarily occupied territories of Ukraine.

Official Terms of the Promotion and details of its implementation:

The Promotion is held to promote WhiteBIT services.

The Promotion is not a game of chance, a lottery, a service in the gambling business, or a contest; these Terms are not a public promise of reward.

Information about the Promotion is provided based on advertising rights.

Participants of the Promotion are adults who are citizens of non-prohibited countries (i.e., other than those mentioned above) or other persons who are residing in such countries and who have fulfilled the following conditions:

• Signed up for WhiteBIT for the first time or are already signed-up users of the exchange and confirmed their identities (KYC);
• During the Promotion Period, they bought, deposited, or already had at least 30 NAMX on the Main or Trading balance on the WhiteBIT exchange and held this amount on their accounts until the announcement of the Winner (the 3rd of October 2023).

For further determination of the Winner, the Organizer will take snapshots of the Total balances of all the NAMX holders on the WhiteBIT exchange three times randomly (on a random date and time) during the Promotion period.

The Conditions of the Promotion must be met within the timeframe of its duration.

Any personal data of Participants in the Promotion is processed to ensure participation in the Promotion, marketing relations, advertising relations, tax relations, and accounting relations.

Employees, representatives, or agents of the Organizer and their relatives (first and second degree of kinship) are not eligible to participate in the Promotion. Suppose at the time of the provision of the Prize, it is established that the person participating in the Promotion cannot be a Participant of the Promotion following these Terms. In that case, such a person is not entitled to receive the Prize.

Participants of the Promotion have the opportunity to become a Winner and to win the Prize of the Promotion — 150 NAMX.

The maximum possible number of Promotion Winners — 1 person.

Based on the results of the Promotion in the period from the 26th of September to the 3rd of October 2023, the Organizer will form a list of Participants who meet the Promotion Terms and Conditions.

IMPORTANT:

• The Organizer will add the Participant’s nickname to the list of Participants according to the amount of NAMX held on his/her Main Balance. For each extra amount of 30 NAMX (in addition to the minimum amount of NAMX specified in the Promotion Terms and Conditions), the Organizer will add the Participant’s nickname to the list as many times as the extra amount is met.
• One Participant’s nickname can be included in the list of Participants at least 1 but no more than 30 times.

• The maximum possible amount on the Total Balance of the Participant that will affect his placement in the list of Participants is 300 NAMX. Participants can keep an amount exceeding 300 NAMX on his/her Main Balance, but a maximum of 300 NAMX will be considered within the framework of this Promotion.

The Promotion Winner will be determined on the 3rd of October 2023, using the random.org service automatically. The Winner is determined by the ranking (a place in the Participants’ list on the https://www.random.org/ service). The Winner’s nickname will be published on the 3rd of October 2023 in this article on the WhiteBIT company blog (https://blog.whitebit.com), as well as a video with the Winner’s selection, will be published on the WhiteBIT YouTube account.

The Organizer credits the Prize to the Winner’s wallet on the Winner’s Main balance on the WhiteBIT crypto exchange within 5 business days from the next business day after the announcement of the Winner on the 3rd of October 2023.

If it is impossible to contact the Winner or if the Winner fails to comply with these Terms, such Winner loses the right to Winner status, and such right passes to the next Winner in the list.

The Winner receives a Prize for free. The Prize cannot be replaced. The Promotion Winner has no right to demand any other compensation from the Organizer. The Organizer does not bear any warranty obligations for the Prize received within the framework of this Promotion and under the conditions specified in these Terms.

The Organizer inclusively performs the accrual of the Prize to the WhiteBIT account of the Winner within 5 business days after the announcement of the Winners. The Winner of the Promotion will be informed about the Prize accrual by a letter to the email address specified during registration on the website https://whitebit.com/ within 5 business days after its accrual.

One Winner can only win one Prize.

In case of non-receipt of the Prize, if the Winner was eligible for it, or in case of any other difficulties, the Winner must contact online support at https://whitebit.com, by email at support@whitebit.com or by chat later than on the 17th of October 2023 inclusive. If the Winner has not applied by the 17th of October 2023, particularly regarding the issue of not receiving the Prize, the Winner loses the right to receive it.

The Winner determined by the Promotion results cannot transfer the rights to receive the Prize to third parties.

The Winner of the Promotion has the right to refuse the Prize.

The Organizer does not compensate for the additional expenses of the Winner related to the receipt of the Prize. Taxation of the income of the Winner who received the Prize is carried out in accordance with the current legislation.

By participating in the Promotion, the Participant understands and agrees that any information voluntarily provided by him, including the Participant’s personal data, may be processed by the Organizer or third parties involved by him to conduct the Promotion, perform all necessary actions related to it (in particular, but not exclusively, informing about the results of the Promotion both in advertising and in another way), as well as further possible sending of information to the Participant, in particular, of an advertising nature, about the following events/competitions/promotions/raffle of the Organizer. By accepting the requirements of these Terms, the Participants thus consent to such processing of personal data for use by the Organizer and/or other authorized Organizers and confirm their full understanding and necessary awareness of the purposes of processing the information provided, as well as the privacy policy: https://whitebit.com/privacy-policy.

At the same time, by participating in the Promotion, Participants of the Promotion confirm their consent to using their surnames and first names without financial compensation, as well as their agreement to comply with other Terms of the Promotion. The Winner confirms their agreement to provide advertising interviews about participation in the Promotion in the media, particularly on radio and television, and to be photographed for producing graphic materials without paying them any monetary compensation. All exclusive intellectual property rights to such interviews and photographs will belong to the Organizer.

The Organizer reserves the right to change the terms and conditions of the Promotion. In case of any changes, information about this will be provided on the website WhiteBIT and the Organizer’s social networks.

The Organizer does not enter into disputes that may arise between Participants of the Prize Promotion. In situations that allow ambiguous interpretations of these Terms and/or issues not regulated by these Terms, the Organizer of the Promotion makes the final decision in accordance with the requirements of the current legislation. At the same time, the Organizer’s decision is final and is not subject to appeal.

The Promotion Organizer is not responsible for the work of the services of telecommunications companies, postal communication, including e-mail, for any errors of the employees of any enterprises/institutions/organizations that ensure the exchange of information between the Promotion Participants and the Organizer, or circumstances as a result of which postal items did not arrive, arrived late, were lost or damaged; or as a result of which the Promotion Participant did not receive the corresponding Prize.

Announcement of the winner

Based on the draw conducted through the random.org service among Participants who meet the Conditions of the Promotion, the Winner and the holder of the 150 NAMX Prize is a WhiteBIT exchange user with the nickname NatakornNo2#3707.
