The Terms and Conditions to the “NAMX Twitter Storm” Promotion

The Organizer of the Promotion is the company UAB Clear White Technologies, incorporated under the legislation of the Republic of Lithuania under the number LT-03224, whose registered office address is: J. Basanaviiaus g. 26 Vilnius, Republic of Lithuania.

The Promotion period: from 2 p.m. (UTC) on the 21st of July, 2023, to 2 p.m. (UTC) on the 27th of July, 2023.

The territory of the Promotion: The Promotion is held on the territory of all countries, with the exception of: Afghanistan, American Samoa, US Virgin Islands, Guam, Iran, Yemen, Libya, Palestine, Puerto Rico, Somalia, North Korea, Northern Mariana Islands, USA, Canada, Syria, Sudan, South Sudan, Transnistria, temporarily occupied territories of Georgia, Nagorno-Karabakh, Northern Cyprus, Western Sahara, Amazonia, Spain, Kosovo, Republic of Belarus, Russian Federation, temporarily occupied territories of Ukraine.

The Promotion is held to promote the WhiteBIT services.

The Promotion is not a game of chance, a lottery, a service in the field of gambling business or a contest; these Terms are not a public promise of reward.

Information about the Promotion is provided on the basis of advertising rights.

The Participants of the Promotion are adult citizens of non-prohibited countries (that is, not of those specified above) or other persons who are legally present in the territory of such countries, and who have fulfilled the following conditions:

• Signed up for the WhiteBIT website and confirmed their identity (KYC);
• Followed the WhiteBIT and NAMX Twitter accounts;
• Retweeted (RT) or quote the post announcing the listing of NAMX on the WhiteBIT crypto exchange on the WhiteBIT Twitter account;
• Tagged 3 persons in the comments under the post announcing this Promotion;
• Bought or topped up their main balances on the WhiteBIT exchange with any amount of NAMX asset and held them until the winners of the Promotion are announced on the 1st of August, 2023;
• Filled out a Google form, using the link in which indicated a nickname on the WhiteBIT exchange, a nickname on Twitter, a link to their retweet, and a comment on Twitter.

The Conditions of the Promotion must be fulfilled within the terms of its implementation.

Any personal data of the Participants of the Promotion is processed for the purpose of ensuring participation in the Promotion, marketing relations, advertising relations, tax relations and relations in the field of accounting.

Employees, representatives or agents of the Organizer and their relatives (first and second degree of consanguinity) are not entitled to participate in the Promotion. If, at the time of awarding the Prize, it is established that the person who participated in the Promotion cannot be a Participant of the Promotion in accordance with these Rules, such a person shall not be granted the right to receive the Prize.

The Participants of the Promotion have the opportunity to win one of the Prizes of the 60 NAMX Prize Pool — 2 NAMX each.

The maximum possible number of Promotion Winners is 30 persons.

According to the results of the Promotion in the period from 07/27/2023 to 07/31/2023, the Organizer forms a list of Participants who meet the Promotion Terms.

The Winners of the Promotion will be determined on the 1st of August, 2023 using the random.org service, automatically, among all Participants who meet the Promotion conditions. Winners are determined by rating (place in the list on the https://www.random.org/ service). The list of winners will be published in this article on the 1st of August, 2023, on the WhiteBIT blog (https://blog.whitebit.com/).

The Organizer will accrue the Prizes to the Main balances of the Winners on the WhiteBIT crypto exchange within 5 business days from the day following the announcement of the Winners.

The Winners of the Promotion will be informed about the winnings and the accrual of the Prize by letter to the email address specified during registration on the website https://whitebit.com/, within 5 business days after the Winners are determined.

One Winner can only win one Prize.

In the event that the Winner cannot be contacted or fails to comply with these Rules, such Winner shall lose the right to the status of Winner, and such right shall pass to the next Winner on the list.

The Winner receives the Prize free of charge. Replacement of the Prize with its monetary equivalent is not envisaged. The Winner of the Promotion has no right to demand any other compensation from the Organizer.

The received Prize cannot be exchanged or returned.

The Organizer bears no warranty obligations regarding the Prize received within the framework of this Promotion and under the conditions specified in these Rules.

In case of non-receipt of the Prize, if the Winner was entitled to it or in case of any other difficulties, the Winner should contact the online support at https://whitebit.com, at the email address support@whitebit.com or in the chat no later than 08/15/2023, inclusively. In the event that the Winner does not apply by 08/15/2023, including on matters of non-receipt of the Prize, the Winner loses the right to receive it.

Winners determined by the results of the Promotion may not transfer the right to receive the Prize to third parties.

The Winner of the Promotion has the right to refuse the Prize.

The Organizer does not compensate the additional expenses of the Winner related to receiving the Prize. Taxation of the income of the Winners who received the Prize is carried out in accordance with the current legislation of the Participant’s country.

By participating in the Promotion, the Participant understands and agrees that any information voluntarily provided to them, including personal data of the Participant, may be processed by the Organizer or third parties engaged by it for the purpose of conducting the Promotion, carrying out all necessary actions related to it (in including, but not limited to, informing about the results of the Promotion both in advertising and in other ways), as well as further possible sending of information to the Participant, including of an advertising nature, about the Organizer’s next events/contests/promotions/draws. By accepting the requirements of these Terms and Conditions, Participants hereby consent to such processing of personal data for the purpose of use by the Organizer and/or other persons authorized by the Organizers and confirm their full understanding and necessary awareness of the purposes of processing the information provided, as well as the privacy policy: https://whitebit.com/privacy-policy.

At the same time, by participating in the Promotion, the Participants of the Promotion confirm their consent to the use of their surnames and names without any financial compensation, as well as their agreement to comply with other rules of the Promotion. The winners confirm their agreement to give promotional interviews about participation in the Promotion in the mass media, including radio and television, as well as to be photographed for the production of graphic materials without paying them any monetary compensation. All exclusive intellectual property rights to such interviews and photographs shall belong to the Promoter.

The Organizer reserves the right to make changes to the Terms and Conditions of the Promotion. In case of any changes, information about this will be provided on the website https://whitebit.com and on the Organizer’s social networks.

The Organizer does not enter into disputes that may arise between the Participants of the Promotion regarding the Prize. In the event of situations that allow an ambiguous interpretation of these Rules and/or issues not regulated by these Rules, the final decision is made by the Promotion Organizer in accordance with the requirements of the current legislation of the Participant’s country. At the same time, the decision of the Promotion Organizer is final and is not subject to appeal.

The Promotion Organizer is not responsible for the work of the services of telecommunications companies, postal communication, including email, for any errors of the employees of any enterprises/institutions/organizations that ensure the exchange of information between the Promotion Participants and the Organizer, or circumstances, as a result of which postal items did not arrive, arrived late, were lost or damaged; or as a result of which the Promotion Participant did not receive the corresponding Prize.
